The terms for ordering, accounts, rewards, Coffee Pass, and gift cards.
Our services and these terms
These terms are between you and Cupp Coffee, LLC, doing business as cupp. They cover the customer website, mobile app, digital ordering at kiosks and counters, rewards, Coffee Pass, gift cards, and related services where these terms are presented. Please read them before using these services. If you do not agree, do not use the digital services.
Specific offer details shown before a purchase or enrollment also apply to that offer. Mandatory consumer rights always apply. These customer terms do not govern suppliers selling goods or services to cupp, and do not promise that every feature is available at every shop.
Eligibility and accounts
You must be at least 13 to use our digital services. If you are under 18, a parent or guardian must authorize and supervise your use and purchases. You must have authority to use the payment method you provide.
Provide accurate account and order details. Keep your password, sign-in codes, and account QR code secure, and tell us promptly about suspected unauthorized use. Do not impersonate someone or access another person’s account. Guest ordering is available where offered; some benefits and history require an account.
Orders, pickup, and product information
Review your shop, pickup time, items, customizations, and total before confirming an order. Displayed preparation and pickup times are estimates. Availability can change, and submitting a payment does not guarantee that an unavailable item can be prepared. If we cannot fulfill a paid order, we will arrange an appropriate resolution, including a refund for items not supplied.
Collect your order at the shop shown in your confirmation. Contact that shop promptly to cancel before preparation starts. After preparation starts, cancellation is not guaranteed. We will offer a refund or remake for missing, incorrect, or unsatisfactory items; contact the pickup shop or our support contact with your order number. An uncollected order does not receive an automatic refund. Tell us if circumstances prevented pickup so we can review the situation. Nothing here limits remedies required by law.
Descriptions and images are illustrative. Ingredients and preparation can vary; our kitchens handle common allergens and cross-contact is possible. Ask the shop about your needs before ordering. Do not rely on a modifier selection alone to communicate a serious allergy.
Prices, payments, tips, and refunds
Prices, taxes, and any selected tip are shown at checkout in U.S. dollars. Prices and availability may vary by shop and channel. Tips are optional. Authorizing a purchase allows the payment shown for that purchase; a separate subscription enrollment governs recurring payments.
Available payment methods depend on the channel. Stripe processes supported card and wallet payments. A temporary authorization may appear before final settlement. Saved payment methods, where offered, are managed through the payment provider.
For order problems and refund requests, contact your pickup shop or the contact below with your order number. Approved refunds are returned through the applicable original payment methods; gift-card refunds return to gift-card balance. For a partial order refund paid using both bank-card and gift-card value, the bank-card portion is returned first, then gift-card value. A full order refund returns each payment portion to its original method. Bank processing can delay when a refund appears. These terms do not create a blanket no-refund policy or limit statutory refund rights.
Rewards and promotions
Rewards are an optional account benefit. Eligible paid purchases earn points under the rules displayed for the program. Taxes and tips do not earn points. Qualifying items, accrual rates, reward costs, tier benefits, bonus requirements, and expiry rules are shown in the rewards experience or specific offer. Review those details before participating.
Points are promotional benefits, not money or a deposit account, and cannot be cashed out or sold. A refund, cancellation, correction, or fraudulent transaction can reverse related points or benefits. Offers may have eligibility, timing, or combination restrictions. Do not create duplicate identities, make self-referrals, or manipulate transactions to obtain benefits.
We may change or end the program with notice where required. Changes will not remove rights that applicable law protects. Closing your account forfeits unused points and account rewards; review the deletion screen before confirming.
Coffee Pass subscriptions
Coffee Pass is optional and available only where offered. Before enrolling, review the plan’s price, billing interval, recurring-payment disclosure, included drinks, daily or period limits, eligible sizes and modifiers, participating shops, and cancellation details. An included drink may still have paid additions shown at checkout. Entitlements are tied to your account and are not transferable or redeemable for cash.
If you enroll in an automatically renewing plan, you authorize the disclosed recurring charge until you cancel. Manage or cancel your subscription through the Coffee Pass management controls provided in your account. Cancel before the next renewal to avoid the next charge. The management screen shows when cancellation takes effect and whether access continues through the paid period. Contact us if you cannot reach those controls.
Deleting the app does not cancel a subscription. Account deletion is different from ordinary subscription cancellation: it ends account access and the pass immediately, and the current deletion flow does not automatically refund unused time. Rights to refunds required by law remain. Failed payments may interrupt benefits. Any material billing changes require the notice and consent applicable law requires.
Gift cards
cupp gift cards are stored value for eligible purchases through supported cupp channels. Check the recipient’s details before sending a gift. Protect claim links and codes like cash; anyone with an unclaimed code may be able to claim it. Only redeem cards you are entitled to use.
Cupp Coffee, LLC is the issuer and is responsible for purchased cupp gift-card value. Current gift cards are digital and are claimed into one cupp account. At launch, gift value can pay supported app and website orders; it cannot purchase another gift card or pay for a Coffee Pass subscription. The current customer experience does not offer gift-card reloads.
Purchased gift-card value does not expire and has no fees. Cards are not bank accounts or credit products. They are not redeemable for cash except where required by law. Promotional credits, if offered, may have separate terms clearly stated with the offer.
See the available balance and transaction activity in Gift cards after signing in to the account that claimed the card. Pending purchases may reserve value until completed or released. Contact support promptly if activity or a balance appears incorrect, or if a gift link or account may have been compromised. Use only cupp’s app, website, or support to check a balance; do not give gift codes to an unofficial balance-checking site.
Purchase, balance, redemption, and payment-combination limits are shown in the gift-card experience. Buying a gift card does not earn points. Eligible merchandise purchases paid with gift value earn points under the normal rewards rules. A purchased gift can be refunded on request while it is unclaimed and unused; contact support with proof of purchase. Once claimed or used, discretionary gift-card purchase refunds are not offered; legally required remedies still apply. Deleting an account removes wallet access but does not forfeit purchased gift-card value. Before deletion, save your gift-card identifier and purchase details and contact support about any remaining value. You can also request recovery after deletion with proof of purchase or ownership. For a missing gift, incorrect recipient, lost code, or refund request, contact us with proof of purchase. We may need to verify ownership before restoring access or taking action. Nothing here forfeits purchased value contrary to law.
Privacy and communications
Our Privacy policy explains our information practices and your choices. Account and transaction messages are part of providing the service. Promotional messaging is subject to your choices and any legally required consent; accepting these terms is not consent to promotional texts. Message and data charges from your carrier may apply to text-based sign-in.
Do not send unlawful, threatening, infringing, or abusive material in gift messages or support requests. You retain rights in your material and permit us to use it to deliver the gift, provide support, or otherwise fulfill your request.
Permitted use and intellectual property
You may use the services for lawful personal purposes. Do not interfere with the service, attempt unauthorized access, exploit payment or reward errors, distribute malware, or misuse other people’s information. Do not use ordering features while driving.
cupp and its licensors own the service’s software, branding, designs, and content. You receive permission to use the services as intended, not ownership or permission to reproduce or commercially exploit those materials. Third-party products, payment services, sign-in providers, and app stores may have their own terms.
Availability, suspension, and responsibility
We work to provide reliable services, but outages and errors can occur. To the extent permitted by law, digital services are provided as available without a promise of uninterrupted or error-free operation. This does not disclaim obligations for purchases or warranties and protections that cannot lawfully be excluded.
We may restrict access when reasonably necessary to address fraud, misuse, legal requirements, or security risks. Contact us if you believe a restriction is a mistake. A restriction does not eliminate obligations concerning paid orders, subscriptions, or gift-card value.
To the extent permitted by law, cupp is not responsible for indirect or consequential losses arising from use of the digital services. This limitation does not exclude liability that cannot legally be limited, including applicable responsibility for personal injury, fraud, or willful misconduct. No provision waives nonwaivable consumer rights.
Questions, disputes, and changes
Please contact us first so we can try to resolve a concern. Utah law governs these terms to the extent consistent with mandatory laws that protect you. These terms do not require arbitration or waive class-action or jury-trial rights. A court with proper jurisdiction may hear a dispute.
We may revise these terms and will update their date. Material changes will receive notice and any required consent before they apply. New terms do not retroactively change completed purchases. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law.
